Third-Party Work Injury Claims in Tallahassee
One Workplace Accident May Create Two Distinct Claims
A workplace accident may create two distinct claims when someone other than the employer contributed to the injury. At Anderson & Hart, P.A., we handle both workers’ compensation matters and civil tort claims arising from workplace injuries. Our attorneys bring over 60 years of combined legal experience to these overlapping claims, representing injured workers in Tallahassee and throughout Florida.
Section 440.11 of the Florida Statutes generally makes workers’ compensation an employee’s exclusive remedy against the employer. However, section 440.39 allows an employee to receive workers’ compensation benefits while pursuing a separate claim against a negligent third party. This negligence claim addresses the responsibility of another person or company whose conduct caused or contributed to the accident.
Call (850) 203-3041 to discuss whether your workplace accident may support both workers’ compensation and third-party claims.
Who May Be Liable for a Workplace Injury in Tallahassee?
A third party is generally a person or business other than the injured worker’s employer. Identifying that party requires examining who controlled the vehicle, product, property, or work activity connected to the accident.
Potential third parties may include:
- Negligent drivers: A driver may be liable for a collision that injures someone performing job duties.
- Equipment manufacturers: A manufacturer may face a product liability claim when defective equipment or machinery causes an injury.
- Property owners: Premises liability may arise when a dangerous condition outside the employer’s control injures a worker.
- Contractors or subcontractors: Another company on a job site may qualify as a third party when workers’ compensation immunity doesn’t apply.
Compensation Available Through a Third-Party Claim
Florida workers’ compensation generally provides authorized medical care and wage-loss benefits. Wage-loss payments are commonly capped at two-thirds of the worker’s average weekly wage, subject to applicable limits and eligibility rules. These benefits don’t include compensation for pain and suffering or other non-economic harm.
A third-party injury claim may seek damages outside the workers’ compensation system, including pain and suffering and lost wages that workers’ compensation didn’t cover. The available damages depend on the evidence, the extent of the injuries, and the third party’s share of responsibility.

Direct Attorney Guidance from Evaluation Through Resolution
We examine workplace accidents for potential claims within and outside the workers’ compensation system. Clients speak and meet directly with the attorney who handles their claims from start to finish. We assess available benefits and potential third-party liability as connected parts of the same accident. We also consider how damages, deadlines, and lien issues may affect each claim.
Since 2004, we’ve represented thousands of clients across Florida in workers’ compensation, personal injury, and Social Security disability matters. We’ve obtained compensation for more than 95 percent of our clients and recovered millions of dollars. Past results don’t predict the outcome of any individual claim.
Request an Assessment of Both Potential Claims
We work on a contingency fee basis, so attorney fees depend on obtaining a recovery. Free and confidential consultations are available in person or virtually. Our contact form is available for consultation requests.
