Florida Workers’ Compensation Benefits After a Catastrophic Injury
Available benefits depend on the medical evidence, work restrictions, wage records, and statutory requirements. Unlike damages in a civil negligence case, standard Florida workers’ compensation benefits don’t include compensation for pain and suffering.
Potential parts of a claim include:
- Medical benefits: Authorized treatment may include hospitalization, diagnostics, medication, medical devices, physical therapy, and other approved care.
- Temporary total disability: These wage-loss benefits may apply while an authorized doctor finds the worker unable to work. Certain qualifying catastrophic injuries may provide benefits equal to 80% of the worker’s average weekly wage for up to six months, subject to current statutory conditions.
- Permanent impairment benefits: These benefits may apply when the worker has a lasting medical impairment after reaching maximum medical improvement.
- Permanent total disability: This category may apply when a worker meets Florida’s requirements for permanent inability to perform qualifying employment. State law also establishes presumptions for certain severe injuries.
- Vocational rehabilitation: Retraining or related assistance may become relevant when permanent restrictions prevent a return to the worker’s previous occupation.
