Premises Liability Attorney in Tallahassee

Representing Tallahassee Injury Victims Hurt on Unsafe Property

Premises liability is a legal claim that holds a property owner or occupier responsible for injuries caused by an unsafe condition on their property. When a hazardous floor, inadequate lighting, or broken stairway causes serious harm, the injured visitor often may have a right to pursue compensation. At Anderson & Hart, P.A., we represent people hurt on someone else’s property and work to recover what they’re owed.

Our firm has been in Tallahassee since 2004, and our attorneys give clients direct access throughout every stage of their claim. You won’t be handed off to a paralegal when you have questions about your case.

If you were injured on someone else’s property, call Anderson & Hart, P.A. at (850) 203-3041 to schedule a free, confidential consultation. We’re available for in-person and virtual meetings.

Why Tallahassee Injury Victims Turn to Anderson & Hart

Paul Anderson, Karla Hart, and Jordan Anderson bring over 60 years of combined legal experience to every case we handle. Since 2004, we’ve recovered compensation for more than 95% of our clients, winning millions of dollars across personal injury, workers’ compensation, and Social Security disability claims. That track record reflects consistent, disciplined case management, not luck.

Clients at Anderson & Hart, P.A. work directly with the attorney handling their case, which means clearer communication, faster answers, and representation that accounts for your specific circumstances rather than a generic playbook.

Premises Liability Claims We Handle

Common premises liability claims include slip-and-fall accidents, negligent security, and injuries caused by poorly maintained property conditions such as missing handrails, uneven pavement, or inadequate lighting. Each case turns on what the property owner knew, or should have known, about the dangerous condition.

One area where our practice stands apart: we handle both workers’ compensation cases and civil tort claims. This matters because a workplace injury isn’t always limited to a workers’ comp claim. When a worker is hurt by a hazard on property controlled by someone other than their employer, such as a delivery stop, a client’s facility, or a leased work site, that worker may be able to pursue a separate premises liability claim against the property owner in addition to workers’ compensation benefits. Few firms are positioned to evaluate and handle both paths at once.

Florida’s Duty-of-Care Framework

Florida law classifies visitors into three categories: invitees, licensees, and trespassers. The duty a property owner owes depends on which category applies.

Visitor Classifications & Duties Owed

Invitees, such as customers entering a store for a mutually beneficial purpose, receive the highest duty of care. Property owners must regularly inspect for and address dangerous conditions for this group. Licensees, such as social guests, receive a lower standard. Under Florida Statute 768.075, trespassers receive limited protection, though property owners can’t intentionally harm them and must warn discovered trespassers of known hidden dangers.

Elements of a Premises Liability Claim

Establishing a premises liability claim generally requires proving four elements: duty, breach, causation, and damages. Duty is defined by the visitor classification. Breach means the owner failed to meet that standard. Causation connects that failure to the injury. Damages establish the harm suffered.

Florida Filing Deadlines & Fault Rules

Florida’s procedural rules directly affect whether and how much a claimant can recover. Two rules in particular require early attention.

Statute of Limitations Under Florida Statute 95.11

For claims arising on or after March 24, 2023, Florida’s statute of limitations for premises liability is two years from the date of injury under Florida Statute 95.11. This change came with House Bill 837, which also tightened other aspects of civil tort law in Florida. Missing the deadline can bar recovery entirely, so acting promptly matters.

Modified Comparative Negligence Under Florida Statute 768.81

Florida follows a modified comparative negligence rule under Florida Statute 768.81. If a claimant is found more than 50% at fault for their own injury, they can’t recover compensation. Property owners and their insurers often argue the injured person contributed to the accident, making it important to build a clear record of the property’s condition. Claims involving government-owned property carry separate notice requirements and timeframes under Florida Statute 768.28.

Compensation Available in a Florida Premises Liability Claim

A successful claim may recover economic damages, including medical expenses and lost income, as well as non-economic damages such as pain and suffering. The full value of a claim often exceeds what a property owner’s insurer initially offers. Insurance companies routinely dispute liability or propose settlements that don’t account for the long-term cost of a serious injury. Having our attorneys evaluate any offer before you accept it can make a significant difference in what you ultimately recover.
