Tallahassee Workers’ Compensation Benefits Lawyers

Board Certified Attorneys, 70+ Years of Combined Experience, 95%+ Success Rate

Florida’s workers’ compensation system is no-fault, meaning injured workers can receive benefits regardless of who caused the accident. It also shields most employers from direct civil lawsuits, making the workers’ comp claim the primary path to pursuing recovery for medical costs, lost wages, and lasting disability. At Anderson & Hart, P.A., our Board Certified Workers’ Compensation attorneys have represented thousands of injured workers across Florida since 2004. Clients work directly with the attorney handling their claim from the first call through resolution.

That direct-attorney access matters when an insurance carrier disputes your injury, questions your wage rate, or pressures you back to work before your doctor clears you. We review your medical records, work history, and wage information and push back aggressively when employers or insurers try to reduce or deny the benefits Florida law provides. Our firm operates on a contingency fee basis, so you pay no legal fees unless we recover for you. Free in-person and virtual consultations are available to injured workers throughout Tallahassee, Panama City, and the rest of North Florida.

Florida Workers’ Compensation Benefits: What You Can Receive

Several categories of benefits are available depending on the nature of your injury or occupational illness. The type of disability your doctor identifies and the wages you earned before the injury both affect what you can receive and for how long.

Medical Benefits

Medical benefits cover the treatment your recovery requires. Insurance carriers are responsible for authorizing and paying for covered care, though disputes over what is medically necessary are common.

Medical benefits cover:

  • Emergency room treatment and hospitalization
  • Prescription medication and medical devices
  • Physical therapy, diagnostics, and specialist care

Lost Wage Benefits

Lost wage benefits begin after a worker misses more than seven days of work. Death benefits are available to dependents of workers who die in job-related accidents. Lost wage benefits fall into four categories tied to your level of disability.

These include benefits for:

  • Temporary Total Disability (TTD): If your treating doctor takes you completely off work, TTD equals approximately 66.67% of your average weekly wage (AWW), subject to a state maximum of approximately $1,358 per week as of 2026. For catastrophic injuries such as loss of a limb, paralysis, or loss of sight in both eyes, the rate may rise to 80% for the first six months.
  • Temporary Partial Disability (TPD): If you return on light duty and earn less than 80% of your pre-injury wages, TPD benefits bridge the gap between your reduced earnings and your prior wage level.
  • Permanent Partial Disability (PPD) / Impairment Benefits: Once you reach Maximum Medical Improvement (MMI), the point at which your condition isn’t expected to improve further, a doctor assigns a permanent impairment rating that determines the amount and duration of additional weekly payments.
  • Permanent Total Disability (PTD): If you can’t perform even sedentary work within a 50-mile radius of your home, PTD benefits may apply and can continue until age 75.

Vocational rehabilitation benefits may also be available to help you retrain for different work when you can’t return to your prior occupation. Insurance carriers frequently dispute AWW calculations, benefit duration, and whether a worker can return to lighter duty sooner than the treating doctor recommends. We handle those disputes directly, presenting a clear picture of how your injury affects your life and earning capacity.

Critical Deadlines & the Two-Year Clock

The most dangerous aspect of a Florida claim is the statute of limitations. Miss a deadline, and your right to benefits can be permanently barred.

  • Reporting the Injury: You must notify your employer of your accident within 30 days. While verbal notice is legal, we recommend providing notice in writing.
  • Filing the Claim: Under Florida Statute 440.19, a Petition for Benefits must generally be filed within two years of the date of injury.
  • The “One-Year Rule”: Once your claim is active, you must receive authorized medical treatment or a disability payment at least once every 365 days to keep the statute of limitations from expiring.

How the Workers’ Compensation Claim Process Works in Tallahassee

After you report your injury, your employer must notify its insurance carrier, which will investigate and decide whether to accept or deny the claim. You may begin authorized medical treatment during this period and, if you can’t work, receive temporary wage-replacement benefits. Questions, paperwork, and disputes are common as the insurer reviews the claim.

Here is a general overview of how the process unfolds:

  • Report the injury to your employer as soon as possible to start the claim.
  • Employer notifies the insurance carrier, which investigates and determines whether to accept or deny the claim.
  • Begin authorized medical treatment with a doctor approved by the workers’ compensation insurer.
  • Receive temporary wage-replacement benefits if your doctor places you out of work or on restricted duty.
  • Attend required evaluations, such as independent medical examinations (IMEs) scheduled by the insurer.
  • File a Petition for Benefits if your claim is denied or benefits are stopped prematurely.
  • Proceed to mediation, hearings, or settlement discussions before a Judge of Compensation Claims in Tallahassee.

Workers’ compensation appeals in Florida go to the First District Court of Appeal, located in Tallahassee. That means the full arc of a disputed claim, from the initial filing through a final appellate decision, can unfold in the same region where you live and work. We guide clients through every step of that process, including disputes heard before a Judge of Compensation Claims.

Common Problems Injured Workers Face in North Florida

Even when a workplace injury clearly occurs on the job, many workers in Tallahassee and surrounding communities encounter unexpected obstacles when trying to access their benefits. Delays in medical approvals, pressure to return to work too soon, reduced wage checks, and disputes over work restrictions can create serious financial and emotional strain.

Some of the most frequent problems injured workers face:

  • Delays in medical treatment approval, including specialist referrals or diagnostic testing
  • Pressure to return to work prematurely, even when you still feel physically unable
  • Reduction or suspension of wage benefits after being placed on restricted duty
  • Disputes over whether the injury is truly work-related
  • Disagreements about the severity of your condition or need for additional treatment
  • Incorrect calculation of your average weekly wage (AWW), which directly affects benefit amounts
  • Challenges related to physically demanding jobs, including heavy labor, long-distance driving on routes like I-10 or U.S. 27, or working outdoors in North Florida’s heat
  • Confusion caused by complex insurance paperwork and benefit notices

Many workers avoid filing claims out of fear of retaliation. Florida law prohibits employers from retaliating against workers who file valid workers’ compensation claims, and workers who face termination or demotion may have remedies beyond the workers’ comp system itself. Our firm operates on a contingency fee basis, so there are no legal fees unless we recover for you. Free in-person and virtual consultations are available throughout Tallahassee, Panama City, and the rest of North Florida.

Workers’ Compensation in Tallahassee & Leon County

Tallahassee is Florida’s state capital, and a substantial share of the local workforce is employed by state government agencies, making state-employer workers’ compensation claims a common category in Leon County. The Florida Division of Workers’ Compensation, which regulates the entire system, is headquartered here. So is the First District Court of Appeal, which reviews all Florida workers’ compensation decisions appealed beyond the OJCC level. Few firms in the state practice in a city where both the regulatory agency and the appellate court for workers’ comp cases are based.

Outdoor, agricultural, construction, and transportation workers across North Florida face elevated exposure to heat-related conditions and physical injury risks that regularly produce disputed claims. Many local workers rely on a single income, meaning an injury-related wage gap creates immediate financial pressure for the entire household. Anderson & Hart, P.A. represents injured workers throughout Leon County and across North Florida. Our record of recovering compensation for over 95% of our clients reflects the approach we bring to every claim, and we’ve helped thousands of individuals across Florida recover millions of dollars since 2004.
